1. Acceptance of Terms

By using Guyana Home Hub (a subsidiary of Caribbean Home Hub), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not access or use our services.

2. Eligibility

You must be at least 18 years of age to use this site. By using the platform, you affirm that you are of legal age and are capable of entering into this agreement.

3. Use of Services

You agree to use this site only for lawful purposes. You must not misuse or attempt to disrupt our platform. We reserve the right to suspend or terminate your access if we believe you are violating any terms.

4. User Accounts

You are responsible for safeguarding your account credentials. We are not liable for any loss or damage resulting from unauthorized access to your account.

5. Listing & Content Policy

You may post property listings or development information in accordance with our rules. Listings must be accurate and not misleading. We reserve the right to remove any content at our discretion.

6. Payments

All payments for premium listings, featured placements, or other paid services are non-refundable unless otherwise stated. Secure third-party providers may process transactions.

7. Intellectual Property

All content on this platform, including text, branding, and logos, is the intellectual property of Caribbean Home Hub and its subsidiaries. You may not reuse or redistribute this content without permission.

8. Disclaimers

We make no guarantees regarding property accuracy, agent performance, or user conduct. You use this platform at your own risk. Listings and other data are provided "as is" without warranties of any kind.

9. Private Listings and User Due Diligence

Definitions

For the purposes of this section:

• "The Platform" refers to Portal Home Hub, its subsidiaries (including but not limited to Guyana Home Hub, Jamaica Home Hub, Kenya Home Hub, South Africa Home Hub, and other country-specific platforms), Caribbean Home Hub LLC, and all affiliated entities.
• "Private Listing" refers to any property listed by a For Sale By Owner (FSBO) seller, private landlord, or any individual who is not a licensed real estate agent or property management company.

Platform Role

The Platform operates as a listing service connecting property sellers, landlords, and prospective buyers/renters. The Platform is NOT a party to any transaction between users and does NOT act as an agent, broker, intermediary, or fiduciary in property transactions.

Verification of Listings

Agent Listings: Properties listed by licensed real estate agents may be subject to professional standards and licensing requirements in their respective jurisdictions. However, the Platform does not independently verify agent credentials, licensing status, or listing accuracy.

For Sale By Owner (FSBO) Listings: Properties listed directly by owners ("For Sale By Owner" or "FSBO") are NOT verified by the Platform. The Platform does not:

• Verify ownership of the property
• Confirm the accuracy of listing information, pricing, or descriptions
• Validate the identity of the seller
• Guarantee the condition, title status, or legal standing of the property
• Ensure compliance with local laws, regulations, or disclosure requirements

Private Rental Listings: Rental properties listed directly by landlords or property owners are NOT verified by the Platform. The Platform does not:

• Verify that the person listing the property owns it or has legal authority to rent it
• Confirm the accuracy of rental terms, pricing, availability, or amenities
• Validate the identity of the landlord or property manager
• Guarantee the condition, habitability, or safety of the property
• Ensure compliance with local tenancy laws or regulations

User Responsibility and Due Diligence

YOU ARE SOLELY RESPONSIBLE for conducting your own due diligence before:

• Making any payments, deposits, or financial commitments
• Signing any agreements, contracts, or leases
• Visiting properties in person
• Entering into any transaction with another user of the Platform

The Platform strongly recommends that users:

• Verify property ownership through official government records or registries
• Meet sellers or landlords in person at the property location
• Never send money, wire transfers, or cryptocurrency before viewing a property in person
• Obtain all agreements, terms, and representations in writing
• Consult with a licensed attorney, real estate professional, or relevant authority in your jurisdiction
• Research market values to identify potentially fraudulent below-market listings
• Report any suspicious activity to the Platform and local authorities

Limitation of Liability for User Transactions

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Platform, Caribbean Home Hub LLC, Portal Home Hub, all subsidiary companies, and their respective officers, directors, employees, agents, partners, and affiliates shall NOT be liable for:

• Any loss, damage, injury, or harm resulting from transactions between users
• Fraudulent listings, misrepresentation, or omissions by users
• Disputes between buyers and sellers, or landlords and tenants
• Any reliance on information provided in user-submitted listings
• Actions, omissions, or conduct of any user on the Platform
• Title defects, encumbrances, or ownership disputes
• Property condition, habitability, or fitness for any purpose
• Failure of any transaction to complete
• Any indirect, incidental, consequential, special, or punitive damages

This limitation applies regardless of whether claims are based on contract, tort, negligence, strict liability, or any other legal theory, even if the Platform has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless the Platform and all affiliated entities from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your transactions with other users
• Your violation of these Terms
• Your violation of any rights of third parties
• Any content you submit to the Platform

Reporting Suspicious Activity

If you encounter a suspicious listing or believe you have been targeted by fraud, please report it immediately to info@portalhomehub.com (or the contact email for your local Platform site). The Platform reserves the right to remove any listing and suspend any user account at its sole discretion, without notice or liability.

Jurisdiction-Specific Requirements

Some jurisdictions may have additional consumer protection laws or regulations that apply to real estate transactions. Users are responsible for understanding and complying with the laws of their jurisdiction. Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws that cannot be waived by agreement.

10. Limitation of Liability

Under no circumstances shall the owners, founders, team members, or affiliates of Caribbean Home Hub be liable for indirect, incidental, or consequential damages resulting from your use of this platform.

11. Governing Law

These terms are governed by the laws of the United States. If you access the service from other countries, you are responsible for compliance with local laws.

12. EU GDPR Compliance
